These Terms and Conditions govern your use of the Beauty Select site and your relationship with Beauty Select Ltd (“Beauty Select Ltd”, “we” or “us”). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the Beauty Select Ltd Site. By using the Beauty Select Ltd Site you agree to be bound by these Terms and Conditions.
Nothing in these Terms and Conditions affects your statutory rights.
These Terms and Conditions were last changed on 10th January 2017.
1.1 When you register with the Beauty Select Ltd Site you must ensure that the details provided by you on registration or at any time are correct and complete. You are hereby confirming to Beauty Select Ltd that you are a ‘qualified Beauty Therapist and that you hold appropriate Public Liability Insurance’. You must inform us promptly of any changes to the information that you provided when registering as a salon owner by emailing Customer Services.
1.2 The Beauty Select Ltd. site shop is for ordering purposes within the UK only. For customers outside the UK, ordering should not be done through this site but through direct contact with the Company.
1.3 When you register to use the Beauty Select Ltd Site we will give you a username and password. You must keep the username and password confidential and must not let anyone else use it. You are responsible for all activities and orders that are submitted using your password. If you think anyone else has your password, please let us know so that we can cancel it.
1.4 We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions. You can cancel this agreement at any time by emailing Customer Services. If you cancel, you must stop using the Beauty Select Ltd Site.
1.5 The suspension or cancellation of your registration and your right to use the Beauty Select Ltd Site shall not affect you or Beauty Select Ltd’s rights or liabilities.
2 Proprietary rights
2.1 The content of the Beauty Select Ltd Site is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of the Beauty Select Ltd Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Beauty Select Ltd Site without written permission from us.
2.2 No licence is granted to you in these Terms and Conditions to use any trademark or service marks of Beauty Select Ltd or its licensors including, without limitation, the trade marks, or service marks Beauty Select Ltd, Callus Peel, Sun Select, Cool Select, Shade Select.
2.3 It is absolutely forbidden to sell to a third party any of the Callus Peel products (with the exception of the Moisture Cream). Failure to adhere to these rights may result in legal action against you. Beauty Select Ltd. sell only to Trade Customers who are, at least, qualified in Pedicures and do not sell to members of the public.
3 Prices and VAT (Sales Tax)
3.1 Our prices are stated in Pounds Sterling and include Sales Tax (VAT) at the rate of 20%
3.2 Our VAT Number: GB 900 587 044.
3.3 We clearly show you the price you have to pay for our products. If, by mistake, we have under-priced a product, we will not have to deliver that product to you at the stated price, provided that we tell you before we post the product. You can then decide if you still want the product.
4 Acceptance of your order
4.1 Our products are sold for professional use only. There will be no contract of any kind between you and us unless we actually dispatch the products to you. Your order (including payment) is an offer to buy from us, so nothing we do or say will amount to any acceptance of that offer until we actually send the product to you. At any point up until then, we may decide not to send the products to you and to give you a full refund. If an item is out of stock, we will let you know and unless you then request your payment be returned we will hold your payment until the product is next in stock. At the moment the goods are dispatched (and not before), a contract will be made between you and us.
5 Delivery and charges
5.1 The cost of packing and delivery is clearly displayed at ‘checkout’ for your approval prior to confirming your order.
5.2 Our delivery within the UK is usually 24-48 hours. (excluding orders sent by Royal Mail, as per the *below).
5.3 Delivery Costs to UK –
DELIVERY INFORMATION:- Orders received by 2 p.m. will be dispatched within 24/48 hours (excluding Saturdays, Sundays & Bank Holidays). All orders (excluding orders sent by Royal Mail, as per the *below) are sent out by APC NEXT DAY COURIER to be received by 5 p.m. the next working day. If your Salon is not open during these hours, then please state your earliest opening time on the ‘Order Notes’ when ordering. If you are NOT in when your order is delivered, the Couriers will try to deliver to a neighbour, but failing that they will leave a CARD which you MUST read as you will have to contact them to organise re-delivery or collect your order from the depot. The Courier company will NOT attempt further deliveries and your order will be returned to Beauty Select Ltd. after 7 days. If any parcels are returned to Beauty Select Ltd. due to non delivery, then you will be charged your standard delivery charge (+vat) for your goods to be redelivered to you.
You MUST contact us if you have not received your order within 3 working days of placing your order, so that we can chase your order up before it is returned to us. Please also check that you have received everything you have ordered within 48 hours of receipt.
*Due to our Courier company charging EXTRA for Central London postcodes that are covered by the congestion charge, they will charge an extra 75p plus vat per delivery.
Anyone ordering with the following post codes MUST RING THE OFFICE TO PLACE AN ORDER as the courier company we use will add on extra charges for the following areas, your order will be delivered by Royal Mail postage which may be more than the standard charge (depending on the weight of the parcel) and it may take 5 working days before you receive your order:- PA, PH, DD, IV, KW, AB10-16, AB21-25, AB30-36, AB37-38, AB39, AB41, AB42-45, AB51-52, AB53-56, HSI-9, IV21-28, IV40, IV41-51, IV52-54, IV55-56, KA27-28, KW1-14, KW15-17, PA20, PA34-40, PA41-49, PA60-78, PA80, PH30-41, PH42-44, PH49-50, ZE1-3, FK19-21 AND ALL NORTHERN IRELAND, CHANNEL ISLANDS, ALDERNEY, HERM & ARK, ISLE OF MAN AND ISLE OF WIGHT.
6 Returned Goods
When goods have been ordered in error or are not as expected, the company may agree to their return on the following conditions:-
6.1 A request must be made to Beauty Select Ltd within seven days of receipt of goods.
6.2 If you wish to return unwanted goods please ensure that any product you have bought is in original condition and unopened.
6.3 Refunds will be subject to the purchase price less 10% handling charge. Carriage charges will not be refunded.
6.4 Returned goods will only be accepted where a Returns Authorisation has been given. The relevant reference number must be quoted on accompanying documentation. For your own protection, please obtain a receipt from the carrier, as the company accept no responsibility for lost parcels.
6.5 Returned products should be sent to Beauty Select Ltd, 1-3 The Courtyard, Calvin Street, The Valley, Bolton BL1 8PB enclosing a copy of the original invoice.
6.6 If goods are received faulty we will replace goods or refund in full within 24 hours on receipt of products being returned to Beauty Select Ltd.
7.1 Prior to dispatch, cancellation will only be accepted subject to a 5% handling charge.
7.2 Cancellations after dispatch cannot be accepted.
8 Availability of Beauty Select Ltd Site
8.1 We try and offer you the best service we can, but we cannot promise that all our products and services will meet your requirements and we cannot guarantee that the Beauty Select Ltd Site will be fault free. If you find a fault, please let us know by contacting Customer Services.
8.2 There will be some times when your access to the Beauty Select Ltd Site is restricted to allow for repairs, maintenance or improvements.
9 Liability of Beauty Select Ltd Site
9.1 The Beauty Select Ltd Site is provided by us without any warranties or guarantees. You must bear the risks associated with the use of the Internet. If we are informed of any inaccuracies in the material on the Beauty Select Ltd Site we will try to correct them as soon as we can.
9.2 In particular we are not liable to you for the following:
9.2.1 Incompatibility of the Beauty Select Ltd Site with any of your computer or telecommunications equipment or software;
9.2.2 Technical problems or errors or interruptions of the Beauty Select Ltd Site;
9.2.3 Inadequacy of the Beauty Select Ltd Site to meet your requirements.
9.2.4 To the full extent allowed by applicable law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (included but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss or privacy or loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Beauty Select Ltd Site.
9.2.5 Nothing in this paragraph 9 applies to liability in respect of products sold through the Beauty Select Ltd Site.
9.2.6 Nothing in these Terms and Conditions excludes liability for death or personal injury caused by our negligence or fraud.
We aim to deal with any complaints in a fair, confidential, swift and effective way. They should be directed to the Company by telephone or email and should include full contact details in addition to your e-mail address together with order number where appropriate.
We may update these Terms and Conditions from time to time and any changes will be notified to you via the email address provided by you on registration or via a suitable announcement on the Beauty Select Ltd Site. The changes will apply to the use of the Beauty Select Ltd Site after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the Beauty Select Ltd Site. If you continue to use the Beauty Select Ltd Site after the date on which the change comes into effect, your use of the Beauty Select Ltd Site indicates your agreement to be bound by the new Terms and Conditions.
12.1 We will only use the information that we collect about you lawfully in accordance with the Data Protection Act.
13.1 We make no promise that materials on the Beauty Select Ltd Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Beauty Select Ltd Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access the Beauty Select Ltd Site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.
13.2 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts. Any contracts between you and us are concluded in English.
13.3 If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
13.4 You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
13.5 If you breach these Terms and Conditions and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
13.6 We shall not be liable for any breach of these Terms and Conditions beyond our reasonable control.
13.7 A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
